drinking and gambling don't mix...

this story is hard to believe, but according to the TAMPA FOX 13 news, this happened on wednesday.  a couple was gambling at the tampa hard rock (i was just there a couple of weeks ago), got drunk and decided to get some sleep in a dumpster, at a nearby gas station. now, the story gets better. the couple is awakened when a dump truck picks up the dumpster and drops the load in a gargage truck. fortunately, the dump truck driver was watching a camera that watches what is dumped into his truck and sees a body. he had not pressed the compress' button. called 911, police/rescue came, both drunks are being treated for back injuries, but they are alive.

I heard a quick version of this story and now I'm just waiting to see who they sue first. Will they sue Tampa Hard Rock under Dram Shop, will they sue the gas station for not protecting the dumpster from knuckleheads who climb into them, do they sue the disposal company for not making a dumpster that people can't climb into, or do they sue everyone including the $9.00 an hour gas station attendant who had nothing to do with it?

In this day and age, unfortunately, people sue everyone but the Pope and who knows. Maybe him too.

They will not sue anyone......someone please explain to me on what basis they would be even "ALLOWED" have their lawsuit even heard in a court?Oh sure they can try.....everyone has the right to FILE a lawsuit, but in order to get to trial there is a definite, legitimate "review" process that is supposed to weed out totally baseless and bogus suits.......do nuisance lawsuits still happen?  of course they do, but a lot of propaganda has been disgorged by the insurance industry that has made people PERCEIVE that this country is lawsuit happy and that the courts are total anarchy, which is totally distorted.....but that is the price a free and democratic society pays for having a system that allows a (theoretically) fair and open and unbiased legal system.I think it is cynical to truly believe our legal system is really THAT messed up and broken to think that this couple will be allowed to see the inside of a court room......they were TRESPASSING AND Dunk and disorderly, at a bare minimum.....they absolutely have NO CASE.But if in fact they DO end up filing suit and it DOES see the light of a court room (and/or they are actually OFFERED monetary settlement!)  Then let me know and I will eat these words......BUT let me qualify one thing:  IF....IF the casino is found to have served them BEYOND a reasonable level of alcohol, then that casino is liable in some shape or form, but it must be PROVEN beyond a doubt and that is very hard for a business such as a casino.....     you and I all know that most DUI cases that involve loss of life or injury DO NOT come back on the establishment (if there is one involved) who may have served the booze to the perpetrator, unless the perp is underage or at some point ASKED to be NOT served and were served anyway.Personal responsibility is indeed sometimes a vague notion in this day and age, but there still is enough "reasonableness" within our laws and courts.......Food for thought:   TORT reform, as it is currently portrayed and espoused by those advocating it (mainly Republicans enthralled to some Insurance lobbyist or to an actual company that has promised the congressman/senator a FAT Salary on their board IF AND WHEN he leaves politics) is a totally biased, unfair and unequal favoritism for LARGE insurance companies and large corporations in all industries.....it takes away basic rights that all people have with regards protecting themselves or gaining damages IF and when they are injured or harmed by others' negligence and bad intentions.Without the ability to sue, this country and society would be at the mercy of wealthiest people and companies....individuals would have no recourse for when they are harmed, and believe me, people are HARMED everyday due to the negligence, bad intentions and greed of others!

I had a strawberry tort for dessert the other night, deliciuous. I know of several dram shop litigations here in Illinois but to my knowledge these two people weren't charged with operating a dumpster under the influence.
