They came close to having a smashingly bad time. are you British? I have not heard that word utilized in such context since Harvard, when I would converse each morning with one of the resident professor's Nannies living in my dormitory.

I hope she was cute at least. I still have one friend from UCONN who I stay in touch with on email that has ties to England. His mom was born there and mom and dad met during WW2. I still hear the jargon that way. Also from one of my favorite TV shows on the Velocity channel called Wheeler Dealers which is based in England. Now back to the original intent of the post....that is why it is O'Douls or Buckler on driving casino trips home saving the real stuff for the Overnights. Actually, I can't tell much difference. Must be getting old.

Reality: Anyone can sue anyone about anything in this country. If you are sued, you are FORCED to take action to defend yourself by responding to the suit, which usually will mean attorney fees and court costs. It may ultimately be thrown out, and you may be awarded reimbursement, but try and collect it.

I am just tired of paying my lawyer to file a response to some silly, frivolous complaint made by someone with no money to pay expenses when the complaint is thrown out. If you do not make a legal response, you are exposed to a summary judgment against you.

I heard a quick version of this story and now I'm just waiting to see who they sue first. Will they sue Tampa Hard Rock under Dram Shop, will they sue the gas station for not protecting the dumpster from knuckleheads who climb into them, do they sue the disposal company for not making a dumpster that people can't climb into, or do they sue everyone including the $9.00 an hour gas station attendant who had nothing to do with it?

well I am not sure about every SINGLE individual state, but in the majority of states in order for a person to FILE a lawsuit they have to come up with some money to even start the process as it costs to file (and of course if they actually have an attorney file it on their behalf, add more costs upfront...)if the suit is deemd baseless or frivolous, then the person who filed it is at the very least on the hook for the other parties court costs (usally payable IMMEDIATELY or within a very short time, like 7-10 days....and if they do not have it they are in serious trouble, but that is unlikely if they had money to actually file it in the first place.......and of course, if they engage an attorney to help them file their lawsuit, no reputable, serious or competent attorney will knowingly file a FRIVOLOUS lawsuit because they can be held liable and their reputation, as well as their license to practice, can be adversely affected.)Bottom line, this does not happen all that often, its is simply the case that, WHEN someone DOES file a ridiculous lawsuit, or when something truly egregious or unfair happens (like the people who lost a 500,000 dollar judgement due to a barking dog) it makes headlines all over the country and people (like us, like we are doing NOW) start talking about it
